this is the place for news, kron4, the bay area's news station. this is the bay area's news station, kron4 news weekend starts now. good morning. the top stories we are following on this saturday, december 28th, the emotionally charged dispute continues on the next step in the care of jahi mcmath. what children's hospital oakland and the teenager's families are saying this morning. good morning. i'm justine waldman. it is 7:00 a.m. on this saturday. thank you so much for being with us. we want to start off with a check of the forecast and jana is here with a look at our forecast. >> you can see waking up to mainly clear skies out there, also pretty chilly temperatures. a mixed bag of 20s, 30s, and 40s so if you're heading out the door here in san francisco, 40 degrees here, upper 30s in

oakland, mid-30s in san jose, 32 degrees in concord, so freezing over there, just two above that in livermore and really chilly in santa rosa sitting in the upper 20s. we will take a look at where those temperatures are headed coming up in my full report. justine. >> thank you so much. our top story this morning is the battle over the care of an oakland teenager on life support. it's becoming a war of words as jahi mcmath's family is running out of time to keep her on a ventilator. after the 13-year-old was declared brain dead following a tonsillectomy more than two weeks ago. kron4's mike pelton joins us live this morning from oakland's children's hospital with the very latest. good morning, mike. >> reporter: justine, jahi's family attorney says they have taken one step forward by getting the alameda county coroner to consent to a move, but several hurdles remains before they can move her to a facility. the court order expires monday evening at 5:00 and ahead of

that deadline, tensions are running high. yesterday we saw a heated exchange between the hospital spokesman and the family attorney. >> apparently you think that your clients -- that you will fight to pull the plug. between the two of us i would rather be on my side anyday. >> providing false hope and creating a hoax that some lady is going to come back when two doctors have told you otherwise -- >> the judge hasn't said she isn't coming up. the judge said under the law she is legally brain dead, period. >> reporter: after one facility fell through, the attorney for jahi's family tells us they believe they found a second long-term care facility that will take jahi in southern california but children's hospital oakland says certain conditions must first be met and they will not perform any necessary surgery on jahi after already declaring her dead. jahi's family attorney says he, the hospital and long-term care facility have begun discussions to move jahi.

the problem now is finding someone to perform necessary procedures. >> all of them have the requirement that there be a gas tick tube and the endo tracheal tube. the endotracheal tube has to be in place for a time before the wound can heal and transport. >> if they want to move the body of this individual we will do everything in our powers so long as it's legally and medically correct to help them. >> reporter: and the deadline again is 5:00 on monday evening. the hospital does plan to take jahi off the ventilator unless a new court order is issued before then. jahi's family says they will do anything and everything to meet all of these requirements. they are going back to court monday morning to seek an extension. justine. >> thanks so much, mike. we will check back with you in our next hour. transit union workers approved a new labor contract with management averting a possible strike. it was the third time union

voted after two previous proposals were rejected this year. the agreement includes a 9 1/2 % wage increase which will be phased in over three years. employees will also now contribute $125 a month to their health care costs. it will now be needed for the agency brokers to a-- board of directors to approve this. their next meeting on january 8th. the search for a navy veteran reported missing in san francisco is over. police have confirmed that 30- year-old derek cell contacted them and said he is okay. derek had not been seen for over a week. that's when friends and family launched an aggressive search effort to find him. san francisco police delivered good news on friday that derek was safe and had called in after seeing his story on tv. derek's father was overwhelmed at the hearing of this news. >> i don't even know how to say i am so relieved and so

thankful, you know, give the media all the difficulty you want for what they do but this would not have happened if you guys had not immediately jumped in because he wouldn't have seen it, he wouldn't have known and so my heart is huge. i am so grateful. >> derek requested privacy when speaking to police. family and friends said for derek to take all the time that he needs. they are glad that he's okay. in san francisco, a body found in the water near pier 48 has now been identified as 22- year-old paula meadow, the student from brazil had been visiting san francisco. he was reported missing in october after he left a disturbing message for relatives saying that he needed help. his sister later came to san francisco from l.a. to file a missing persons report. police are saying the case could now become a homicide investigation. a man from the bay area has been killed in an avalanche in wyoming. this happened thursday near a resort in jackson hole.

the man named michael kaczynski was skiing the black country with friends. that's when they apparently triggered an avalanche. rescuers found the 29-year-old about a half an hour later. according to his facebook page he graduated from cal berkeley and his family now released a statement saying that mike lived life with a full heart and that he loved his family, the cal bears and skiing with his buddies. his parents say they are grateful they will -- they are grateful they were able to spend one last christmas with him. a person is in grave condition this morning at the hospital after being shot last night in east oakland. police say that the shooting happened on the 2300 block of 96th avenue at about 11:00 last night when officers arrived, they found the victim suffering from at least one gunshot wound. no information was immediately available and no arrests have been made this morning and police are still investigating. two santa rosa men arrested in connection with a christmas eve robbery.

the snowstorm county sheriff's -- sonoma county sheriff's office tells us the robbery happened around 6:30 in the morning. deputies arrested two people, 21-year-old ricardo dovales and 20-year-old devonte love. the victim was struck in the head with an unknown object before that robbery. the sheriff's office says the victim was hospitalized for severe head trauma. still much more to get to here on the kron4 news weekend. the time is 7:07. live look outside at our camera showing us what is happening. i believe this is our camera showing us walnut creek so a lot of people out there this morning. the camera showing us haze and fog out there today. so we will take a look at the forecast when we come right back. stay with us.

earlier this month following comments he made in an interview with "gq" magazine. in the article robertson called homosexuality sinful and questioned claims of the mistreatment of blacks during the precivil rights era. opinions about a&e's decision to end his suspension are mixed. >> we think he had the right to say it and we believe in the same morals and christian beliefs that phil believes in so we are behind him 100%. >> the comments were pretty harsh. there's a way of saying things. if you don't agree with something, there's ways to word it where you're not trying to, you know, dehumanize someone. >> robertson thanked his supporters in a statement on his facebook page, a&e said now that it will air public service announcements that promote unity and tolerance. esquire magazine named the best dressed man of 2013 and he wears a lot of white. the magazine gave pope francis

every house in the neighborhood of fenton, michigan has been without power for seven days. people say they have gotten used to the constant hum of generators but getting used to life with no electricity is it -- is not as easy. one woman says she has to go to extreme measures just to use the bathroom. >> while on the back deck, shovel my snow, put it in my christmas tote and drag it in, heat my water up, put it in the bucket and then i go over to the toilet and fill it up so i can flush toilets in here. >> that is pretty extreme. utility crews are working to restore the neighborhood's power but they say it could be as late as tonight before the lights and the toilets come back on. the flu season has officially started here. the cdc is urging people to get their flu shots after the number of states reporting a seasonal flu activity jumped from four to 10 last week. new york, texas and alabama are

next week and wrap up the year, it is going to be dry here so taking a look at satellite and radar, this is why we have high pressure in place, keeping any storm track far to the north of us so dry conditions are going to stick around here in the bay area. as for your temperatures, certainly a chilly start in the north bay, 29 degrees if you're heading out the door in napa, 26 in santa rosa, upper 20s in novato. heading out the day in hayward, 39 degrees there. afternoon highs, another round of 60s, so 68 degrees for los gatos, 67 degrees for those of you in ever greene -- everybody -- evergreen. sanlee getting to about -- san leandro -- mid-60s across the board for the north bay. seven day around the bay, going to continue to see the sunny and mild conditions here in the bay area so mid-60s for the

the u.s. military will more willing to come forward due to the heightened attention to the crime. officials say this might explain why the number of reported sexual assaults went up by 50% this year remember more than 5000 reports of sexual assaults were filed during the fiscal year that ended on september 30th. compare that to the just over 3000 that were reported last year. police have released new documents in the newtown shooting investigation. the papers describe adam lanza's mother as a parent who acknowledged that her 20-year- old son appeared to be spiraling downward but was not aware to what extent. nancy lanza told a lifelong friend days before the massacre that her son was becoming increasingly dispond dent. about two -- despondent. two weeks later he shot her in the head, gunned down 20 first graders and six educators at sandy hook elementary school and then killed himself. the pages also discuss lanza's

fascination with violence and the brave attempts by school employees to protect the children. the debate over the nsa's collection of phone records is heating up once again in court this time. a federal judge in new york ruled on friday that the nsa's phone surveillance program is legal and said that the program was necessary in the fight against terrorism. the decision comes just days after a second federal judge said it was likely not constitutional. the opposing ruling set the stage for a federal appeals court. however, some believe that this debate will now end up being settled by the supreme court. despite a string of summertime flops, hollywood is expected to have a banner year at the box office. coming in just shy of $11 billion, that is the largest annual take ever. but because of higher ticket prices, actual attendance at theaters remained flat after a decade of decline. high profile slots such as the

lone ranger, after earth and turbo were offset by mega hits like "fast and furious 6", ironman 33, a strong haul and holiday slate boosting this year's holiday total as we hit the end of the year. debit card pin data when target was hacked, they do have the numbers. the company says the pins were encrypted and that this strongly reduces the risk to customers. however, a security analyst is now saying that the pins are vulnerable and you should change them. target also says this morning that law enforcement officials have launched a forensic and criminal investigation into the breach. we will take a quick break here on the kron4 news weekend. when we come back, we will find out what is happening with jahi mcmath, the 13-year-old still on life support at children's hospital in oakland. we will get an update on her condition after this.

governing. our top story on this saturday, the battle over the care of an oakland teenager on life support became a war of words outside of children's hospital oakland. the hospital says it will release the body of jahi mcmath if the family can get a doctor to perform the insertion of a breathing tube and a nourishment tube, provide transportion -- transaction and provide a facility that is willing to have her body. they had it out on the front steps of the hospital on friday. >> apparently you think that your clients, that you will fight to pull that plug. between the two of us i would rather be on my side any day. >> providing false hope and creating a hoax that some young lady who is deceased is somehow going to come back when a judge has told you otherwise and two doctors have told you otherwise? >> the judge has not said she is coming back. you're out of your mind. this is the problem in doctors. they make up things. the judge said under the law she is legally brain dead,

period. >> the hospital says it will help the family with their wishes as long as things are done in a legal and ethical way. jahi's family has located a second nursing home willing to provide her long-term care after another facility here in the bay area backed out. the lawyer for the mcmath family says the facility in southern california, but he's not naming the name just yet. we will have a live report from the hospital in 30 minutes from now. we want to find out today's forecast. we have a look at a very dry, yet sunny one. good morning. >> good morning to you. it's the view from our mount cam and sunshine chilly start, especially for the northbound bay this morning so pulling up those numbers, if you're heading out the door in santa rosa, 26 degrees there, 28 degrees currently in novato, mid-30s in oakland, upper 40s in fremont and upper 30s currently in the south bay. now as we head into the afternoon it's going to be another sunny, hazy day,

temperatures pretty much 60s across the board with the exception of the coast our daly city, 59 degrees, 62 degrees for san francisco today, mid- 60s for richmond, oakland, 62 degrees the high for fremont and 63 degrees expected for livermore. as we head into the evening hours, we are going to continue to see mainly clear skies. temperatures going to be dropping down to at about 8:00 p.m. if you're headed out this evening in san jose, 50 degrees. we will take a look at the extended forecast coming up in a bit. justine. >> thank you so much. the power is now back on in the east bay after a squirrel caused a blackout. pg&e restored the power to customers in the dark. pg&e says the outage was apparently caused by a squirrel that came in contact with a piece of electrical equipment connected to a bank of transformers. the latest spare-the-air alert extended now through today. that means no fires indoors or

outdoors with wood, charcoal or any other solid fuel. this is the sixth spare the air day in a row. we have also found out there's this new study by mit that says san francisco's unhealthiest air can be found in the inner mission. both the inner and outer mission are bordered -- bordered by freeways. those are known health risks but people living in the inner mission are six times more likely to suffer from pulmonary disease because in the outer mission they are more likely to have trees. the study recommends planting more trees to combat freeway pollution and even encourage homeowners now to install green roofs. it's one thing to have unhealthy air outside, but what about inside your home as well? lawrence berkeley lab researchers are warning people with gas ranges to be aware they are exposing themselves to toxic fumes. they say something even as harmless as boiling water can lead to respiratory problems.

people with gas ranges are being urged now to use a range hood whenever a gas flame is ignited. >> so this flame right here is probably producing nitrogen dioxide and articles. we want to put this pot of cold water onto the flame, then cold pot is interrupting the flame that's probably producing some carbon monoxide now, so the combination of the things can build up in your house to levels that we say are unhealthy. when you cook, if you have one of these hoods above here and it vents to the outdoors that you want to turn it on before you start cooking, leave it other while you're cooking -- it on while you're cooking and maybe a little while after. >> researchers say the fans in range hoods were more effective at cutting down pollution from the back burners. now you have to see this picture. this is the stolen phone selfie in oakland. that wasn't the right video but we will get it for you.

in oakland police searching for two cell phone thieves. they say one of the armed robbers took a photo of himself with a stolen phone. it was in august that authorities say a woman was walking down east 28th street when two men demanded her phone and a necklace. she gave it to them but she had her phone set up that any photos taken on that phone would be automatically uploaded to the internet so police were then able to track down the suspect because he took a photo of himself with her phone. so there's now a $2500 reward being offered. hopefully we will get that picture for you in our next hour. and santa cruz county now offering residents recycling options for their christmas tree, including free curbside pickups and drop-off locations. the trees will be chipped to serve as mulch for landscaping and burned to generate electrical power. there are some rules for recycling trees including the taller trees have to be cut to a maximum of 6 feet at curbside pickup. the dates for when pickup

starts depend on where you live so you can find information on the santa cruz county department of public works website. i would just put this out there, maybe take all your ornaments off it before you put it out for recycling. also this morning the marin humane society holding a pet food drive to gather more donations of pet food, toys, treats and other supplies. this is for their special human animal relationship or share program. the program works with the shelters such as the novato humane society and helps them pair with companies that do low income help. they help people who have low income residents who have pets. if you donate them, they help the low income things. that got confusing. you cannot donate items for dogs and cats. they will take things for rabbits and birds as well. donations dropped off to the novato humane society or any pretty food express stores in marin. take a quick break here on the kron4 news weekend and we will be right back.

more than a million people are losing extended unemployment benefits today including 213,000 people here in california. we get the very latest from sullen safordy. >> reporter: this is what the last six months have been like for paul. >> i've answered 500 want ads on one website alone. >> reporter: at 52 he's been out of work in educational publishing and now another blow. he's one of 1.3 million americans losing unemployment benefits. on average, they have been getting $300 each week. his check wasn't nearly november to cover the $1100 a month rent on his new york apartment and now it will stop coming. >> i won't be able to buy food or pay my bills. >> reporter: extended unemployment benefits beyond the usual 26 weeks started

during the bush administration to help americans hit by the recession. since 2008 they have been renewed 11 times. but not this time. congress failed to pass an extension in the budget deal, teeing up a nasty fight for the new year. >> it's going to be classic messy washington politics over an issue where the two parties don't have united view. this is one of those issues that the right flank wants to fight on. >> reporter: some republicans say it's time to end the program altogether. they argue it's too expensive, a year's extension costs $25 billion. people have gotten dependent and they say the economy is strong enough now without them. >> when you extend benefits to, you know, 73 weeks or 99 weeks, it encourages some people to stay unemployed too long and that makes it increasingly hard for them to get back into the workforce. >> reporter: democrats say benefit checks get spent right

mountain but all around pretty pleasant conditions. another spare the air day so a mix of hazy sun out there but sunny and mild and we are going to continue to see these conditions actually tomorrow as well as we head into the week. taking a look at satellite and radar, we did have the high to midlevel clouds streaming through yesterday but that system has pushed out of our area and on the tail end of that we have high pressure building so this means any storm track is going to stay well to the north of us so it's going to continue to stay dry here in the bay area as we wrap up the year. as for your temperatures, certainly a chilly start in santa rosa, 26 degrees there, 28 degrees currently in napa, mid-40s here in downtown san francisco, upper 30s in half moon bay and waking up to about mid-30s in livermore this morning. we've got another round of 60s for our afternoon highs, so upper 60s expected for los gatos, campbell, 66 degrees the high for st. clair. lynn valley, low 60s along the delta, 64 degrees for danville and fairfield, low to mid-60s

declared brain dead following a tonsillectomy more than two weeks ago. kron4's mike pelton joins us now from children's hospital oakland with the very latest. good morning, mike. >> reporter: good morning, justine. you know, the hospital says it will allow a transfer as long as it's done legally and ethically but during that process certain requirements must be met. jahi's family attorney tells us that they have met one of those by getting the alameda county coroner to approve a possible move but they are now running up against the clock. the court order keeping jahi on a ventilator expires monday evening at 5:00 and ahead of that deadline we have seen tensions run high here at the hospital. yesterday we saw a heated exchange between the family attorney and a hospital spokesman. >> apparently you think for your clients that you will fight to pull that plug. between the two of us i would rather be on my side any day. >> providing false hope and creating a hoax that some young lady who is deceased is somehow going to come back when a judge has told you otherwise and two doctors have told you

otherwise? >> the judge hasn't said she is not coming back. you're out of your mind. this is a problem with spin doctors, they make up things. the judge said under the law she will legally brain dead, period. >> reporter: after one facility fell through, the attorney for jahi's family tells us they believe they found a second long-term care facility that will take jahi in southern california but certain conditions must be met first and children's hospital oakland will not perform any necessary surgeries on jahi after already declaring her brain dead. jahi's family attorney says he, the hospital and long-term care facility have begun discussions ho move jahi. the problem now is finding a way to complete necessary procedures. >> all of them have the requirement that there be a g tube, the gas tick tube and the -- gastric tube and the end tracheal tube. the problem is the endotracheal tube has to be in place for a period of time in order for the wound around it to heal before there can be transport. >> they won't take no for an answer and that's very sad but if they want to move the body

of this individual we will do everything in our powers so long as it's legally and medically correct to help them. >> reporter: jahi's family has set up an online donation site to try and raise funds for her transfer. again, that deadline is monday at 5:00 in the evening. children's hospital oakland has indicated they do plan to take jahi off the ventilator unless a court order -- or new court order is issued or if she is transferred by that time. jahi's family has indicated they could be back in court on monday to seek an extension. justine. >> thanks so much, mike. we will check back with you the next hour. ac transit union workers now approved a new labor contract with management averting a possible strike. it was the third time unions voted after two previous proposals were rejected earlier this year. the agreement includes a 9 1/2 % wage increase which will be phased in over the next three years. employees will also contribute $125 a month to their health care costs. now, this needs to be approved by the agency's board of

directors in a meeting on january 8th. the search for a navy veteran reported missing in san francisco is over this morning because police confirmed that 30-year-old derek sell contacted them to confirm he is okay. derek has now not been seen, though for over a week. that's when friends and family launched an aggressive search to find him. san francisco police delivered the good news on friday that derek was safe and they -- he called in after seeing his story on television. derek's father was overwhelmed after hearing this good news. >> i don't even know how to say i am so relieved and so thankful, you know, give the media all the difficulty you want for what they do but this would not have happened if you guys had not immediately jumped in because he wouldn't have seen t he wouldn't have known and -- seen it, he wouldn't have known. my heart is huge. i'm so grateful. >> derek requested privacy when

speaking to police. we don't know his exact location. family and friends said that derek should take all the time that he needs. they are just glad that he's okay. in san francisco, a body found in the water near pier 48 has now been identified as 22- year-old paulo netto, a student from brazil who had been visiting san francisco. he was reported missing in october after he left a disturbing message for relatives saying that he needed help. his sister later came to san francisco from los angeles to file a missing person's report. police are saying that this case could become a homicide investigation. a man from the bay area has been killed in an avalanche in wyoming. this happened on thursday near a resort in jackson hole. the man, michael kazanjy was skiing the back country with friends when they apparently triggered an avalanche. rescuers found the 29-year-old about half an hour later and

through today. that means no fires indoors or outdoors with wood, charcoal or any other solid fuel. this is the second spare-the- air day in a row. a new study just out by m.i.t. saying that san francisco, the unhealthiest air here can be found in the inner mission. both the inner and outer missions are bordered by freeways that's a known health risk but people living in the inner mission are six times more likely to suffer from pulmonary disease because in the outer mission they have more trees. the study recommends planting more trees to combat freeway pollution and even encouraging homeowners to install quote green roofs. it's one thing to have unhealthy air outside but what about inside your home as well? the berkeley lab researchers are washing people -- warning people with gas ranges to be aware they are exposing themselves to toxic fumes. they say even something as harmless as boiling water can lead to respiratory problems.

people with gas ranges are being urged now to use a range hood whenever a gas flame is ignited. >> this flame right here is probably producing nitrogen dioxide. want to put a pot of cold water onto the flame and then the cold pot is interrupting the chrome that's probably producing carbon monoxide now so the combination of those things can build up in your house to levels we say are unhealthy. when you cook if you have one of the big range hoods out here and vents to the outdoors then turn it on before you start cooking, leave it on while you're cooking and then maybe a little while after. >> researchers say that fans and range hoods were more effective at cutting down pollution from the back burners. now this is a picture you have to see it as the stolen phone selfie. in oakland police are searching for two cell phone thieves. they say one of the armed robbers took this photo of himself with the stolen phone.

in august authorities say a woman was walking down east 28th street when two men demanded her cell phone and a necklace. she gave it to them but she had her phone set up so that any photos taken on it would be automatically uploaded to the internet. so police believe that the suspect took this photo of himself. a $2500 reward is now being offered. santa cruz county will soon offer residents recycling options for their christmas trees. it will include free curbside pickups and drop-off locations. officials say the trees will be chipped to serve as mulch for landscaping or burned to generate electrical power. there are rules, though for recycling trees including the taller trees must be cut down to a maximum of 6 feet for curbside pickup. the dates when pickup starts depends on where you live in santa cruz county so residents can find a recycling guide on the santa cruz county department of public works website. also this morning, the

ambassador. the mayor has now presented her with a key to the city and a year long pass to the mobile museum of art. dumping your christmas tree on the curb is a lot like tossing out a perfectly good turkey dinner if you're a goat at least. the owners of a colorado goat ranch are asking for old christmas trees. they say their goats love to eat them. owners say that the eating of the trees is a form of roughage that can help the goats clean out their systems, if you know what i mean. they are even offering to pick up your trees for people who live near their ranch. the goats only need about one hour to take an entire tree down just to a pile of twigs. i guess there's a lot of fiber in christmas trees. electricians are working right now on top of a new york city skyscraper to install the last of the 2688 crystal triangles that gives the times square new year's eve ball all

mcmath's family is running out of time to keep her on a ventilator. after the 13-year-old was declared brain dead following a tonsillectomy more than two weeks ago. the situation has been ongoing and kron4's mike pelton joins us right now live from children's hospital oakland with the very latest. good morning, mike. >> reporter: justine, children's hospital oakland will allow jahi to be transferred to another facility as long as her family arranges it and it's done legally and ethically. however, jahi's family is running out of time. the court order keeping jahi on a ventilator here expires monday evening at 5:00 and ahead of that deadline, we have seen tensions running high. it was yesterday afternoon that we saw a very heated exchange between the family attorney and the hospital spokesman. >> apparently you think for your clients that you will fight to pull that plug. between the two of us, i would rather be on my side any day. >> providing false hope and creating a hoax that some young lady who is deceased is somehow going to come back when a judge has told you otherwise and two doctors have told you

otherwise? >> the judge hasn't said she is not coming back. you are out of your mind. this is the problem with spin doctors they make up thing. the judge said under the law she is legally brain dead period. >> reporter: the facility -- the attorney for jahi's family tells us they believe they found a second long-term care facility that will take jahi in southern california. however, certain conditions must first be met. jahi's family attorney says the county coroner did consent to a potential [ audio difficulty ] >> reporter: however, children's hospital oakland said they will not perform any surgery on -- >> all of them have the requirement that there be a gastric tube and the endotracheal tube. the problem is the endotracheal tube has to be in place for a period of time in order for the wound around it to heal before there can be transport. >> they just won't take "no" for an answer and that's very sad but if they want to move the body of this individual, we will do everything in our power

so long as it's legally and medically correct to help them. >> reporter: he says he, the hospital and long-term care facility have begun discussions to move jahi but you heard the family attorney there talking about not only do they need these procedures done, they need time for them to heal but children's hospital oakland says they plan to take jahi off of the ventilator unless a new court order and unless the hospital reverses course and decides to help the family with these procedures, the family attorney says we can expect him back in court on monday to seek an extension. >> thank you, mike. of course we will be following that story for you here on kron4. an ac transit union workers approved a new labor contract with management averting a possible strike. it was the third time unions voted after two were rejected e this year. the agreement now includes a 9 1/2 % wage increase which will be phased in over the next three years and employees will

also contribute $125 a month to their health care costs. the agency's board of directors needs to approve this contract and their next meeting is on january 8th. the search for a navy veteran reported missing in san francisco is over this morning. police have now confirmed the 30-year-old derek sell contacted them to say that he is okay. derek had not been seen for over a week. that's when friends and family launched an aggressive search to try and find him. san francisco police delivered good news on friday that derek was safe and had called in after seeing his story on television. derek's father was overwhelmed at this good news. >> i don't even know how to say i'm so relieved and so thankful, you know, give the media all the difficulty you want for what they do but this would not have happened if you guys had not immediately jumped in because he wouldn't have seen it, he wouldn't have known

and so my heart is huge. i am so grateful. >> derek requested privacy when speaking to police so we don't know his exact location but family and friends said that derek should take all the time that he needs. they are just glad that he's okay. also in san francisco, a body found in the water near pier 48 has been identified as 22-year-old paulo netto, the student from brazil had been visiting san francisco. he was reported missing in october after he left a disturbing message for his relatives saying that he needed help. his sister later came to san francisco from los angeles to file a missing persons report. police are saying now that this case could become a homicide investigation. a man from the bay area has been killed in an avalanche in wyoming. this happened on thursday near a resort in jackson hole. the man, michael kazanjy was skiing in the back country with friends, that's when they apparently triggered an avalanche. rescuers found the 29-year-old

about half hour later and according to his facebook page he had graduated from cal berkeley. a person is in grave condition this morning in the hospital after being shot last night in east oakland. police say the shooting happened on the 2300 block of 96th avenue at about 11:00 last night when officers arrived, they say that they found a victim suffering from at least one gunshot wound. no suspect information was immediately available this morning and we have not heard of any arrest just yet. police are still investigating the shooting. lots more ahead here on the kron4 news weekend. we want to find out what jan wahl has in store. the camera zooming in on her and her fabulous hat. >> i'm ready for my close-up, mr. demille. actually i'm ready to tell you about my top 10 movies of the year which will be next week. this week three big new movies, two not so hot but one fabulous and a few other things to see on this holiday weekend. that's coming up.

day in a row. a new study by m.i.t. says san francisco's unhealthiest air can be found in the inner mission and the outer mission as well because they are both boarded by freeways. but people who live in the inner mission are six times more likely to suffer from pulmonary disease because in the outer mission they are more likely to have trees. the study recommends planting trees to try to combat freeway pollution and also encourages homeowners to install green roofs. it's one thing to have unhealthy air outside but what about inside your home as well? lawrence berkeley lab researchers warning people with gas ranges to be aware they are exposing themselves to toxic fumes. they say something as seemingly harmless as boiling water can lead to respiratory problems. people with gas ranges are being urged to use a range hood whenever a gas flame is ignited. >> so this flame right here is

photos would be automatically uploaded to the internet and police believe that the suspect took this photo of himself. there is now a $2500 reward being offered to find him. in santa cruz county, they will soon be offering residents recycling options for their christmas trees that will include free curbside pickups and drop-off locations. officials say that the trees will be chipped to serve as mulch for landscaping or burned to generate electrical power. there are some rules for recycling trees that include that taller trees have to be cut to a maximum of 6 feet in order to be picked up on the curb. the dates for when pickup starts depends on where you live in the country so you can visit the country's public works website to get the very latest information. now the marin county humane society is holding a pet food drive so they can gather more donations of pet food, toys, treats and other supplies. this is for their special human animal relationship or share

good morning. at about 9:40, more a million people are losing their extended unemployment benefits today including 213,000 people in california. we got the very latest from sullen saffordy. >> reporter: that is what the last six months have been like for paul housey. >> i have answered over 500 want ads on one website alone. >> reporter: at 52 he's been out of work in educational publishing and now another blow. he's one of 1.3 million americans losing unemployment benefits. on average, they have been getting $300 each week. housey's check wasn't nearly enough to cover the $1100 rent on his new york apartment and now it will stop coming. >> i won't be able to buy food, i won't be able to pay my

bills. >> reporter: extended unemployment benefits beyond the usual 26 weeks were started during the bush administration to help americans hit by the recession. since 2008 they have been renewed 11 times. but not this time. congress failed to pass an extension in the budget deal teeing up a nasty fight for the new year. >> it's going to be classic messy washington politics over an issue where the two parties don't have a united view. this is one of the issues that the right flank wants to fight on. >> reporter: some republicans say it's time to end the program altogether. they argue it's too expensive, a year's extension cost $25 billion. people have gotten dependent and they say the economy is strong enough now without them. >> when you extend benefits to 73 weeks or 99 weeks it encourages some people to stay unemployed too long and that makes it increasingly hard for them to get back into the

"the secret life of walter mitty," it should have been great. it's based on a 1937 story by james -- about a hapless day dreamer. he dreams big. in 1947 danny kay starred in the movie version but now ben stiller has his own version, starring as a man looking at a magazine shifting over to digital. that's relevant. working for life magazine, great touch in this movie. he loses an important negative, leads to tracking down an exstin trick -- eccentric photographer played by sean penn. the family with this -- the

problem with this film, walter's fantasies are not specific. the cinematography is beautiful but not the film. badly directed. here's movies i hope people will see right now, "american hustle," "frozen" for the entire family and wonderful, ma dina mansell is a fantastic singer. wonderful, wonderful "frozen."
